Rebels Cafe expressly disclaims any obligation to monitor its Customers and other Users. Rebels Cafe has no liability or responsibility for the actions of any of its Customers or other Users or any content any User may post on any Web site.
Reporting Non-Copyright Violations
Rebels Cafe encourages Users to report violations of this policy by e-mail to: Rebels Cafe Complaints, including in any such report the name/screenname of the offending member, email address and post the type of abuse (for example, Spam, illegal acts, harassment, etc.) along with the required and posted requested information.
Reporting Copyright Violations
Rebels Cafe complies with the Digital Millennium Copyright Act ("DMCA"). Rebels Cafe encourages Users to report an alleged copyright infringement involving a user by sending a notice that complies with the DMCA which information is located under the DMCA section of this website.
Member Usage Rules
You agree that when using the Rebels Cafe Site, you will act in a manner consistent with the goals of the Rebels Cafe Site, and by way of example, and not as a limitation, you specifically agree that:
You will not, intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulation or law.
You will not post information on or download information from the Rebels Cafe Site unless you have all rights and authority necessary to do so.
You will not post any inappropriate, defamatory, foul, vulgar, obscene, sexually explicit, potentially libelous or slanderous, infringing, harmful, harassing, threatening, illegal, or otherwise objectionable material or information to the Rebels Cafe Site, including but not limited to, text, graphics, audio, and video files.
You will not defame, abuse, harass, stalk, threaten, embarrass, cause distress, unwanted attention or discomfort, or otherwise violate the legal rights (such as rights of privacy and publicity) of any visitor to the Rebels Cafe Site (“User”) or representative of Rebels Cafe. You may express your disagreement with someone’s point-of-view, but personal attacks, or attacks based on another person’s race, national origin, ethnicity, religion, gender, sexual orientation, disability or other such condition or circumstance, are strictly prohibited.
You will not impersonate another person or entity, including but not limited to, a Rebels Cafe representative, or communicate under a false name or a name that you are not entitled or authorized to use.
You will not post surveys, contests, chain letters, pyramid schemes, unnecessarily long messages, unnecessary or repetitive posts, multiple ratings for the same item, meaningless text, spamming, offensive declarations or exhortations, or other similarly disruptive content.
You will not falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material posted on the Site.
You will not post any files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
You will not attempt to “crack,” “hack,” “bomb,” manipulate or otherwise gain unauthorized access to other User accounts, Rebels Cafe servers, Rebels Cafe Services, Rebels Cafe software, or any areas of the Rebels Cafe Site not intended for your access.
You will not post, transmit, or distribute any unsolicited advertising, promotional materials or other forms of solicitation to Users, individuals or entities, except in areas designated by Rebels Cafe for such purposes.
You will not harvest, mine or otherwise collect or store personal information about others, including, without limitation, email addresses and the content of User profiles.
Reservation of Rights
Rebels Cafe reserves the right to cooperate with appropriate legal authorities in investigations of claims of illegal activity involving Rebels Cafe Services, Customers/Members and other Users. Rebels Cafe reserves all other rights to respond to violations of this or any posted policy to the extent of applicable law and in accordance with any applicable contractual obligations. Rebels Cafe may utilize technical means to monitor communications into, and out of, its network facilities to prevent the introduction of viruses or other hostile code, to prevent intrusions and otherwise to enforce this or any posted policy and each Customer agrees that Rebels Cafe is authorized to monitor its communications through Rebels Cafe network for such purposes.
Remedies
If Rebels Cafe learns of a violation of any posted policy, Rebels Cafe will respond to the applicable Customer/Member and may, in Rebels Cafe sole discretion, take any of the following actions, in accordance with the severity and duration of the violation:
a. Warn the Customer/Member; and/or
b. Suspend the offending Customer/Member from the Services; and/or
c. Terminate the offending Customer/Member from the Services; and/or
d. Impose fees or charges on the offending Customer/Member account in accordance with the applicable service contract; and/or
e. Remove the offending content; and/or
f. Take other action in accordance with this or any posted policy, the applicable service contract or applicable law.
Violation of any of the above may result in a warning, immediate termination of member account (with or without notice) and access to the Rebels Cafe Site, reporting of your conduct to authorities, or legal action, as may be appropriate in the sole discretion of Rebels Cafe. Rebels Cafe has no liability or responsibility to Users or any other person or entity for performance or nonperformance of the aforementioned activities.
